Temporary Protected Status

Temporary Protected Status or TPS is given to those from countries USCIS has deemed temporarily unsafe. Civil war, other armed conflicts, and natural disasters are examples of these circumstances. Link to USCIS TPS countries list is provided.

Temporary Protected Status (TPS)

TPS is an immigration status for foreign nationals whose home countries are temporarily unsafe. Countries designated for TPS all have one of the following:

  • Ongoing armed conflict (such as civil war) or other political turmoil

  • An environmental disaster such as earthquakes, floods, or other natural disasters

  • Other extraordinary and temporary conditions

USCIS regularly makes changes to their List of Countries Currently Designated for TPS. If you believe your home country is on the TPS list, it’s important to check to make sure that is still the case.

Although TPS and asylum are similar humanitarian protections, they have an important difference. Asylum is granted when an individual is unsafe, while TPS is granted because an entire country or region is unsafe. If you believe you qualify for asylum or TPS, contact Martinez Immigration Law for a free consultation.
